    Great advice. Another consideration are traffic specific statutes/ordinances banning the use of handheld devices while driving. In this regard, a city local to my practice recently passed a traffic related statute calling for citations of drivers using a phone while operating a vehicle, which has been strictly enforced. I think this is as much of an alternative source for generating revenue as it is safety, but it is another reason employers and their employees should be careful about using such devices while driving. And if an accident does happen, plaintiffs’ counsel are increasingly asking for cel-phone records and employment policies relating to usage while driving.
